Buyerly.ai provides property data reports for informational purposes only. We are not financial advisors, investment advisors, legal advisors, registered valuers, mortgage brokers, or building inspectors. Nothing on this website or in our reports constitutes financial, investment, or legal advice. You must seek independent professional advice before making any property purchase decision.

1. Acceptance of Terms

By accessing or using the buyerly.ai website or services ("the Service"), and in particular by completing a purchase of a property report, you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms in full, you must not use the Service or purchase a report. Your continued use of the Service and/or completion of a purchase constitutes your binding acceptance of these Terms.

2. Service Description

Buyerly.ai provides AI-assisted property data compilation reports for Australian residential properties. Our reports aggregate data from publicly available sources, third-party data providers, and proprietary datasets to produce an informational summary about a given property address.

Our reports are delivered as digital documents and are intended solely to assist buyers in understanding available data about a property. Reports are not property valuations, building inspection reports, pest inspection reports, strata reports, legal title searches, or professional appraisals of any kind.

3. No Financial, Investment, or Legal Advice

THE INFORMATION PROVIDED BY BUYERLY.AI DOES NOT CONSTITUTE AND MUST NOT BE RELIED UPON AS:

  • Financial advice or financial product advice within the meaning of the Corporations Act 2001 (Cth)
  • Investment advice or a recommendation to buy, hold, or sell any property or asset
  • Legal advice of any kind
  • A property valuation or market appraisal
  • Advice on stamp duty, capital gains tax, negative gearing, or any other tax matter
  • Advice on mortgage suitability, borrowing capacity, or financing
  • A building, pest, or structural inspection report
  • A strata or owners corporation report

Buyerly.ai is not licensed under the Australian Financial Services framework and does not hold an Australian Financial Services Licence (AFSL). No employee, contractor, or representative of Buyerly.ai is authorised to provide financial product advice.

4. Independent Professional Advice Required

Before making any decision to purchase, sell, or otherwise deal with any property, you must obtain independent advice from appropriately qualified and licensed professionals, including but not limited to:

  • Licensed conveyancer or property lawyer — for title searches, contract review, and legal due diligence
  • Australian Financial Services (AFS) licensed financial advisor — for investment suitability and financial impact
  • Registered property valuer — for a formal market valuation
  • Licensed building and pest inspector — for structural, defect, and pest assessments
  • Mortgage broker or lender — for borrowing capacity and loan suitability
  • Registered tax agent or accountant — for stamp duty, CGT, and investment tax implications
  • Strata manager or body corporate — for strata title properties

Our report is a starting point for research, not a substitute for any of the above professional services.

5. Data Accuracy Disclaimer

While we strive to compile accurate and up-to-date information, Buyerly.ai makes no representation or warranty — express or implied — as to the accuracy, completeness, currency, reliability, or fitness for purpose of any data or information contained in our reports.

Property data may be incomplete, contain errors, be outdated, or not reflect recent events (including sales, renovations, zoning changes, or market movements). You acknowledge that you use our reports entirely at your own risk.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE AUSTRALIAN LAW, BUYERLY.AI, ITS DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any financial loss, investment loss, capital loss, or loss of profit arising from any property decision made in reliance on our reports
  • Any loss arising from inaccurate, incomplete, or outdated data in our reports
  • Any consequential, indirect, incidental, special, punitive, or exemplary damages of any kind
  • Any loss arising from your failure to obtain independent professional advice
  • Any decision to purchase, not purchase, sell, or otherwise deal with a property
  • Any difference between data in our reports and actual market conditions, valuations, or property attributes
  • Any third-party data inaccuracies included in our reports

Our total aggregate liability to you for any and all claims arising under or in connection with these Terms or our Service shall not exceed the amount you paid for your report (AUD $99).

7. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited.

To the extent that any such guarantee or warranty applies and cannot be excluded, our liability is limited (at our discretion) to: (a) re-supplying the service; or (b) refunding the amount paid for the service.

8. Payment Terms

A one-time payment of AUD $99 (inclusive of GST where applicable) is required to generate a property report. Payment is processed securely by Stripe. By completing payment, you agree to these Terms and our Privacy Policy. All prices are in Australian dollars.

9. Refund Policy

If we are unable to generate a report for your requested property due to insufficient data coverage, you will receive a full refund within 5 business days. No refunds are available for completed and delivered reports except where required by Australian Consumer Law.

10. User Eligibility

You represent that you are at least 18 years of age, have legal capacity to enter into a binding contract, and are using the Service for lawful purposes. You agree to provide accurate information when using the Service.

11. Intellectual Property

All content on buyerly.ai, including text, graphics, logos, software, and report templates, is the property of Buyerly.ai or its licensors and is protected by Australian and international copyright laws. Your purchased report is licensed to you for personal, non-commercial use only. You may not reproduce, distribute, resell, or publish report content without our prior written consent.

12. Disclaimer of Warranties

THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Indemnification

You agree to indemnify, defend, and hold harmless Buyerly.ai, its directors, officers, employees, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) any property decision made in reliance on our reports; or (d) your violation of any applicable law.

14. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Resell, sublicense, or redistribute any report or its contents without our written consent
  • Attempt to reverse-engineer, scrape, or copy our data sources or methodology
  • Misrepresent our reports as professional valuations, financial advice, or legal advice to any third party
  • Interfere with the security or operation of the Service

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, and the laws of the Commonwealth of Australia applicable therein. You submit to the exclusive jurisdiction of the courts of New South Wales for the resolution of any dispute arising from these Terms.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
